FLEUR DE LUXURY — TERMS OF SERVICE
Effective Date: January 1st, 2026



These Terms of Service (“Terms”) govern access to and use of the Fleur de Luxury website (the “Site”) and purchases made through the Site or other ordering channels (including phone, text, email, or social media).
Fleur de Luxury is an online-only business and does not operate a public walk-in retail storefront. By using the Site or placing an order, you agree to these Terms.


WEBSITE USE
You agree to use the Site only for lawful purposes and in compliance with applicable laws. You must not attempt to disrupt, damage, interfere with, or gain unauthorized access to the Site, servers, systems, or networks, or use the Site in a way that infringes the rights of others.


LICENSE TO VIEW SITE MATERIALS
Permission is granted to temporarily access and view one copy of the materials on the Site (information or software) for
personal, non-commercial, transitory viewing only. This is a license, not a transfer of title. Under this license, you may not: (a) modify or copy materials; (b) use materials for commercial purposes or public display; (c) attempt to decompile or reverse engineer any Site software; (d) remove copyright or proprietary notices; or (e) transfer materials to another person or “mirror” materials on any other server. This license automatically terminates if you violate these restrictions. Upon termination, you must destroy any downloaded materials in your possession (electronic or printed).


INTELLECTUAL PROPERTY
All Site content and materials—including text, graphics, logos, designs, product photos, images, videos, audio, and software—are owned by or licensed to Fleur de Luxury and are protected by intellectual property laws. Unauthorized use is prohibited.


PRODUCT VARIATION & SUBSTITUTIONS
Floral products are natural and handcrafted; therefore, each arrangement is unique and may vary from photos shown online. Photos are for reference only. Substitutions may be necessary due to seasonality, weather, and market availability; substitutions will be of equal or greater value and maintain the intended style.
Roses will never be replaced with non-rose flowers without your prior authorization. Detailed delivery, refund, and replacement rules appear in our policy pages referenced below.


POLICY PAGES INCORPORATED BY REFERENCE
Our
Delivery Policy, Privacy Policy, and Privacy & Return Policy are incorporated into these Terms by reference and form part of your agreement with Fleur de Luxury. If there is a conflict, the most specific policy for the issue (delivery vs. privacy vs. refund/replacement) will apply.


DISCLAIMER
The Site and materials are provided on an
“as is” and “as available” basis. To the fullest extent permitted by law, Fleur de Luxury disclaims all warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fleur de Luxury does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.


LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fleur de Luxury and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost data, lost profits, or business interruption) arising out of or related to use of (or inability to use) the Site or services. Fleur de Luxury’s total liability for any claim related to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some limits may not apply to you.


ACCURACY, REVISIONS & ERRORS
Materials on the Site may include technical, typographical, or photographic errors. Fleur de Luxury does not warrant that Site materials are accurate, complete, or current. We may make changes to the Site, products, pricing, availability, or content at any time without notice.


THIRD-PARTY LINKS
The Site may contain links to third-party websites. Fleur de Luxury is not responsible for the content, privacy practices, or policies of any linked sites. Use of third-party websites is at your own risk.


FORCE MAJEURE
Fleur de Luxury is not responsible for delays, non-performance, or inability to deliver caused by events beyond our reasonable control, including but not limited to governmental or municipal mandates, emergency orders, shutdowns, severe weather, road closures, natural disasters, utility outages, civil disturbances, labor disruptions, or third-party service interruptions (“Force Majeure”). In such cases, orders will generally be
rescheduled to the next available date when delivery is legally and safely permitted, or we may offer store credit or other reasonable solutions. Refunds during Force Majeure events are not guaranteed except as required by law and are subject to production status and any materials already purchased or committed.
For
events/special orders (including orders associated with an invoice or custom materials), if special materials have already been purchased or committed, you may be eligible for store credit (not a cash refund) depending on timing and costs incurred, consistent with our Privacy & Return Policy.


PAYMENT DISPUTES / CHARGEBACKS
If you have an issue with an order, you agree to contact us first so we can attempt to resolve it. Chargebacks or disputes for delivered/performed services may be contested with proof of fulfillment.


GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. You agree that any dispute arising out of or relating to these Terms, the Site, or any order shall be brought exclusively in the state courts located in Leon County, Florida, or the United States District Court for the Northern District of Florida (Tallahassee Division), and you consent to the personal jurisdiction of such courts.


CHANGES TO THESE TERMS
We may revise these Terms at any time by posting an updated version on the Site. The version in effect at the time you place an order will apply to that order.
